Does the City of Kinston have a burning ordinance?
No. The City does not have a burning ordinance within the City of Kinston Municipal Code of City Ordinances. The burning ordinance was stricken-ed from the ordinance code back in the 1980's.

With that being said, there is however, a city ordinance code within the Health and Sanitation Chapter, Chapter 13, under Article II. - Offensive Accumulations, Section 13-26. Conditions declared a public nuisance (1), which states; "Any accumulation of animal or vegetable matter that is offensive by virtue of odors or vapors.....etc."

Thus if a call from a neighbor or citizen that has a concern of smoke/ash, which is the bi-product of burning the vegetable matter, would be considered as a "Public Nuisance" and unless an absolute reason to survive, meaning either providing heat in extreme emergency weather conditions or used for cooking to sustain life, will be extinguished by the Fire Company dispatched to investigate and remove the nuisance.
