Special meetings may be called by the chairman or 2 members. The commission shall keep full and accurate records of all meetings and of any official action taken consistent with its charter. The City Manager and/or Director of Public Services shall provide relevant information to the commission with regard to issues reviewed, deliberations thereof and recommendations made to the city council. The City Manager and/or Director of Public Services shall attend each meeting.

Members

The Utilities Advisory Commission is composed of 7 members residing within the City of Kinston's utility service area. Five members shall reside within the corporate limits of the City and two members shall reside outside the corporate limits of the City. All members must be customers or employees of an industrial/business customer of the City of Kinston utility systems at the time of their appointment to the commission.

Members are appointed to staggered 4-year terms. At the discretion of the City Council, commission members may serve consecutive terms. Members appointed to fill an unexpired term shall be entitled, at the discretion of the City Council, to appointment for consecutive 4-year terms at the expiration of the unexpired term to which they are appointed. The term of the chairman, vice-chairman and any other officers shall be for 1-year with eligibility for re-election. The City Manager and/or Director of Public Services shall serve as ex-officio, nonvoting members.

Commission members shall be customers of recognized ability and sound business judgment, who in the opinion of the city council can understand the complexities of utility services and finance and who will perform their official duties in the best interests of the city and the customers of its utility systems. Effort will be made by the city council to select individuals who are so qualified and who represent the demographics of the city and county.

Terms

Terms of commission members shall expire June 30. As the term of each member expires, a member may be reappointed in compliance with such limitation as the City Council may establish with regard to the commissioner or a successor shall be appointed by the City Council to fill an unexpired term or a full term of four years. All appointments shall be by majority vote of the membership of the City Council. If a member of the commission establishes a residence after his or her appointment whereby he/she is no longer a customer of the City of Kinston utility systems or is no longer employed by an industrial/business customer of said utility system, such commissioner shall be removed and replaced as a member of the commission.

Advisory Body

The commission shall act as an advisory body to the City Council, City Manager and Director of Public Services. It shall review and make recommendations regarding policy changes affecting utility operations and maintenance. The commission shall perform such other duties as the City Council may direct. All recommendations and/or decisions made by the commission shall be consistent with all codes and policies of the city, the city's utility systems and, in the case of electricity, the North Carolina Eastern Municipal Power Agency.

Utilities Budget

The commission shall review and make recommendations to the City Manager concerning the utilities budget. The budget recommendations shall be presented to the City Manager for his/her review and presentation to the City Council. The City Manager at his/her discretion may seek and consider additional information provided by the Director of Public Services or the commission.
